Terms and Conditions
These are the rules that govern your use of this site and the services offered on it. By using the site you agree to follow them, along with all applicable laws. If you do not agree, please do not use the site.
We may change these terms at any time, effective when posted here. We may also change, suspend, or discontinue any part of the site or the services on it without prior notice. Using the site after a change means you accept the changed terms.
1. Renting from us
Rentals are covered in full by our Rental Agreement, which you accept at checkout. It sets out delivery timing, exchanges, the return window, the $10 damage waiver, late fees, replacement costs, cancellations, and the card we keep on file. In short:
- Rental items are loaned to you and must be returned. You never own them.
- Your order arrives about 10 days before your event and is due back within three days after it.
- Late returns are $20 per day. After 10 days the rental is treated as lost and replacement costs apply.
- Placing an order authorizes us to charge your card for that order and for any further fees incurred under the Rental Agreement.
- If the event creator pays for the party, that person is responsible for those members' payments and any fees they incur.
2. Buying from us (Purchase Agreement)
Items you buy are yours to keep.
Returns and exchanges. Unused purchases may be returned or exchanged within 14 days of delivery, unworn and unaltered, with original tags. Refunds go back to the original payment method within 3 to 5 business days of the return reaching us. If the fit is wrong we will exchange it free.
Custom and altered items. Alterations void the return. Once an item has been altered to fit you it is yours.
Final sale. Some items cannot be returned or exchanged, including clearance items, special orders, custom or altered items, worn items, and anything marked Final Sale at the time of purchase.
Restocking. A restocking fee of up to 10% may apply to returned purchases.
3. Prices and availability
We work to keep prices, sizes, and availability accurate. If something is listed incorrectly or becomes unavailable after you order, we will contact you and either correct it or refund you in full. Prices can change at any time before an order is placed.
4. Sales tax
New Jersey does not charge sales tax on formalwear, so no sales tax is added to rentals or purchases.
5. Shipping
Rental orders ship free both ways, with a prepaid return label in the box. Purchase orders ship free over $139. We ship within the United States only. Full detail is on our Shipping and Returns page.
6. Your information and your account
You are responsible for the accuracy of the sizing, contact, and address details you give us. Incorrect measurements or a wrong address are the most common reason a rental does not work out, and we cannot guarantee a fix if we are told late. 7. Payment
Rental orders are processed through Authorize.Net, which securely stores your card so anything owed after your event can be settled as described in the Rental Agreement. Purchases are processed through Shopify's checkout.
8. Free groom and ring bearer
The groom's rental is free once the event has five or more invited members in the party. You do not have to wait for everyone to pay: the offer applies as soon as the party reaches five. One free groom rental per event. The offer covers the groom's rental garments; the $10 damage waiver still applies. Non-transferable, no cash value.
Ring bearers on a qualifying event (five or more invited members) get 25% off their rental, applied automatically. It also covers rental garments only, and the damage waiver still applies.
9. Personal effects
We are not responsible for personal property returned to us with a rental order, accidentally or otherwise.
10. Use of this website
Except as expressly allowed here, no part of this site and no content on it may be reproduced, copied, republished, posted, publicly displayed, encoded, translated, transmitted, or distributed in any form without written consent from The Tuxedo Club.
You agree not to attempt to gain unauthorized access to the site by any method, not to interfere with the site or any systems or networks connected to it, and not to access the site under a fictitious identity or disguise your communications. We may terminate or interrupt your access to the site at any time without notice.
11. Limitation of liability
Our responsibility for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.
12. Governing law
These terms are governed by the laws of the State of New Jersey.
