Acceptance of Terms & Conditions
The following Terms and Conditions govern your use of this website and the products and services offered by The Tuxedo Club ("we," "us," or "our"). By accessing or using this website, placing an order, or using any of our services, whether online or in-store, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you should not use this website or purchase or rent products from us.
We reserve the right to modify, update, or replace these Terms at any time by posting the revised version on this website. Changes become effective immediately upon posting unless otherwise stated. Your continued use of this website or our services after any changes have been posted constitutes your acceptance of the revised Terms.
These Terms apply to all rental and purchase transactions made through our website, in our retail showroom, by telephone, by email, or through any other ordering method offered by The Tuxedo Club.
Rental Agreement
This Rental Agreement governs your rental of tuxedos, suits, accessories, shoes, and other rental merchandise ("Rental Items") from The Tuxedo Club. It applies to all rental orders, whether placed online, in-store, by telephone, or by electronic mail.
By placing a rental order, you acknowledge that you have read, understood, and agreed to all of the terms contained in this Rental Agreement.
Payment
Payment for online rental and purchase orders is due in full at the time the order is placed. For in-store rental orders, a minimum deposit of fifty percent (50%) may be collected at the time of ordering, with the remaining balance due before the order is shipped or picked up. The Tuxedo Club reserves the right to require full payment at the time of ordering for any order.
The total amount charged may include, as applicable: Rental fees, Purchase prices, Applicable sales tax, Damage waiver fees, Shipping and handling charges, Rush processing fees, Alteration fees, Any additional charges disclosed during checkout or at the time of purchase. By placing an order, you authorize The Tuxedo Club to charge your selected payment method for the total amount due, including any additional fees permitted under these Terms.
Authorization to charge your card on file
By providing a credit card, debit card, or other payment method, you authorize The Tuxedo Club to charge that payment method for all amounts due under this Agreement, including but not limited to: Rental fees, Purchase prices, Shipping charges, Applicable taxes, Damage waiver fees, Late fees, Replacement costs, Damage charges, Processing fees, Any other amounts authorized under these Terms. Additional charges may be processed without further notice if they result from your failure to comply with this Agreement, including the late return, loss, theft, or damage of Rental Items.
If the event organizer or any designated individual elects to pay for multiple rental orders, that individual accepts responsibility for all authorized charges associated with those orders, including any late fees, replacement costs, or other charges incurred under this Agreement.
Receipt of Order
You are responsible for inspecting and trying on all items immediately after receiving them, regardless of whether your order was shipped to you or picked up at one of our locations. If you discover a sizing issue, damage, missing item, incorrect item, or any other problem, you must notify us:
- Within forty-eight (48) hours of delivery for shipped orders; or
- No later than two (2) business days before your event for in-store pickup orders.
These deadlines are essential because they provide us with sufficient time to prepare and deliver replacement items before your event. Failure to notify us within the required timeframes may prevent us from providing replacements or resolving the issue before your event and may limit the remedies available under our Fit Guarantee.
Exchanges and Reports of Issues
If you experience a sizing issue, receive the wrong item, discover damage, or are missing any Rental Item, you are entitled to one (1) complimentary replacement shipment or exchange, provided that you notify us within the required reporting period described in the Receipt of Order section above.
All exchange requests and reports of any issues must be submitted through our online exchange form at thetuxedoclub.com/pages/request-an-exchange. Requests must be submitted:
- Within forty-eight (48) hours after delivery for shipped orders; or
- No later than two (2) business days before your event for in-store pickup orders.
Late Exchange Requests. Exchange requests received after these deadlines are subject to a $15 processing fee and will be handled on a best-effort basis only. While we will make every reasonable effort to accommodate late requests, we cannot guarantee product availability or delivery before your event. Any expedited shipping or processing charges required for a late exchange are the responsibility of the customer.
Traveling Before Your Event. Our complimentary exchange shipping is designed to ensure replacement items arrive in time for your scheduled event. If you request that a replacement be delivered earlier than our standard exchange timeframe because you will be traveling or otherwise unavailable before your event, you will be responsible for any additional expedited shipping charges required to meet your requested delivery date. Standard replacement shipping remains free when the replacement is shipped according to our normal delivery schedule.
Style Changes. Requests to change styles, colors, or accessories after your order has been shipped are subject to a $15 processing fee, plus any applicable shipping charges.
Fit Limitations. Our rental inventory includes a wide variety of sizes and fits, and we will always work to provide the closest available fit through our exchange process. If, in the rare case, none of our available rental sizes can provide an acceptable fit, or if the requested alterations exceed what can reasonably be performed on rental garments, we may cancel the rental and issue an appropriate refund after all Rental Items have been returned before the event. This provision reflects the limitations of rental garments and does not create an obligation to provide custom tailoring.
Sizing/Order Adjustments
You authorize The Tuxedo Club and its trained outfit specialists to review and adjust the sizes selected for your rental order whenever we believe doing so will improve the overall fit. Our sizing recommendations are based on customer-provided measurements, sizing information, prior fitting experience, and our proprietary fitting process. Because every individual's body shape and fit preferences are different, an exact fit cannot be guaranteed. If adjustments are made to your order, they are made solely for the purpose of improving fit and customer satisfaction. Should any Rental Item still not fit properly, our Fit Guarantee allows eligible customers to receive a replacement in accordance with the Rental Exchange Policy above.
Cancelling, Changing, or Postponing Your Rental Order
Cancellations and Order Changes. Rental orders may be cancelled or changed up to 21 calendar days before the event date. Cancellations made by this deadline are eligible for a refund minus a $35 cancellation fee. Changes requested after this deadline may not be possible and may be subject to additional processing or shipping charges.
Postponements. If your event is postponed before your rental has shipped or been picked up, we will make reasonable efforts to move your reservation to the new event date, subject to inventory availability. If your rental has already been received, you will need to purchase a rental extension to cover the additional time.
Except where required by law, The Tuxedo Club does not guarantee refunds or credits for cancelled events, venue changes, weather conditions, travel interruptions, personal scheduling conflicts, or other circumstances beyond our control.
Our Commitment to Customer Care. Although the policies above represent our standard terms, we recognize that unexpected situations may occur. Whenever reasonably possible, we may approve exceptions as a customer-service courtesy. If we approve a cancellation after garments have already shipped or become unavailable for other customers, any refund will be reduced by applicable costs already incurred, including but not limited to: the standard cancellation fee, shipping charges, return shipping costs, dry cleaning, processing fees, other non-recoverable expenses. Any exception granted by The Tuxedo Club is made solely at our discretion and does not obligate us to grant similar exceptions in future situations.
Rental Delivery, Shipping & Returns
Shipping. Non-rush rental orders over $139 qualify for free shipping both ways. Orders between $75 and $139 pay one-way shipping and receive free return shipping. Orders under $75 pay shipping both ways. We ship only to valid residential, business, or nationally recognized hotel addresses within the continental United States. We do not ship to PO Boxes, Alaska, Hawaii, or Puerto Rico.
Rush Orders. Rental orders placed within 3 weeks of the event are subject to a $50 rush fee and will ship as soon as possible. The rush fee covers expedited shipping when necessary and helps ensure your rental arrives with time to try it on before your event.
Delivery. Rentals are scheduled to arrive 10–14 days before the event, unless an earlier delivery option was purchased at booking. Once an order has been handed over to the shipping carrier, delivery is outside of our control. We are not responsible for delays caused by the shipping carrier. Customers are responsible for monitoring their shipment using the tracking information provided and should contact us promptly if a shipment appears to be delayed.
Rental Returns. All Rental Items remain the property of The Tuxedo Club and must be returned within three (3) calendar days after your event date. Rental Items will be considered returned on time if they are either scanned into transit by the shipping carrier or dropped off at our store within three (3) calendar days after the event date listed on your order.
- For shipped orders, one prepaid return shipping label is included with your rental. Once that label has been used, any additional return shipments are the customer’s responsibility. If you lose your original return label, contact us for a replacement, or return the items at your own expense. If you choose to use your own shipping label or carrier, you must provide the tracking number to The Tuxedo Club immediately after shipment.
- For in-store pickup orders, Rental Items must be returned to the pickup location during regular business hours within the required return period.
You are responsible for ensuring that all Rental Items are returned on time. The Tuxedo Club is not responsible for any personal belongings returned with your rental. If any items are returned separately or after the return deadline, you are responsible for arranging and paying for the additional shipment. You may use any shipping service of your choice. Please email the tracking number to info@thetuxedoclub.com immediately after shipment. Failure to return Rental Items within the required timeframe may result in late fees and, if applicable, replacement charges as described in this Agreement.
Lost or Stolen Packages
All orders are shipped with tracking through UPS or FedEx. A package is considered delivered when the carrier's tracking confirms delivery to the address provided on the order.
If your package is lost, delivered to the wrong address, delayed, or otherwise has a delivery issue, you must contact us at info@thetuxedoclub.com within 48 hours of the carrier's recorded delivery time or delivery issue. If the carrier confirms that the package was lost or delivered incorrectly, we will send a replacement at no charge, provided the issue is reported promptly and replacement items are available.
If tracking shows the package was delivered to the correct address but you did not receive it, or the package was stolen after delivery, you must notify us within 48 hours. For stolen packages, we may require a police report and may provide a replacement at our discretion, depending on garment availability and the timing of your event. Replacements for packages confirmed delivered and subsequently lost or stolen are not guaranteed.
We are not responsible for packages that are lost or stolen after confirmed delivery when the issue is not reported within the 48-hour window. Customers are responsible for monitoring tracking and making arrangements to receive and secure their packages promptly.
For rental orders, this does not affect your responsibility to return all rental items on time. Missing rental items may still be subject to applicable late fees and replacement charges.
Customer Alterations
You are permitted to make non-permanent alterations to the jacket or pant length at your convenience. However, reimbursement for alteration costs is only available if we provide prior authorization in advance of the alteration being done. We will not reimburse for any alterations that were not approved in advance.
If authorized, we will reimburse you up to $35.00 in total, provided that:
- You receive written confirmation from us stating we will cover the alteration cost,
- The service is completed before your event date,
- You email us a valid, dated receipt before the event date.
Fees
In addition to the cost of your rental, the following fees may also apply as detailed in this Rental Agreement. In the event you incur any additional fees, your payment card or account will automatically be charged.
Late Fees & Replacement Costs
Late fees. Any rental items that are not in transit within 3 calendar days after the event date will be charged at the rate of $20.00 per day, per person/tuxedo, until the items are returned or the applicable replacement cost is reached. Late fees that have already been charged are non-refundable. If you need more time, contact us before your return date to purchase a Rental Extension (see below).
Damage Waiver. A non-refundable $10 Damage Waiver is included with all rentals that protects you from liability from reasonable-use damage of your tuxedo. This covers minor wear and tear that our garments may endure during your event such as broken buttons, broken zippers, minor tears or stains. If a rental item is destroyed beyond repair, the below replacement costs will apply. Any items damaged beyond repair, or that are not returned to The Tuxedo Club within 21 days of your event date, will result in replacement/processing costs as listed below, which shall be billed on the payment card or associated payment method that was given at the time of order. You will not receive any refund or other payment after returning your items.

Rental Extensions
If you need to keep your Rental Items longer than the standard rental period, you may purchase a Rental Extension. Each extension is $25.00 and covers seven (7) additional calendar days, per person/tuxedo.
An extension period begins the day after your standard return period ends. (Rental Items are normally due back in transit within three (3) calendar days after your event date; a paid extension moves that deadline out by seven (7) days.) Additional consecutive extensions may be purchased in the same seven-day, $25.00 increments.
Your Rental Items must be in transit back to us by the end of your paid extension period. If they are not, the standard late fees and, where applicable, the replacement costs described above will apply for each day beyond your extension. Purchasing an extension does not change your responsibility to return all Rental Items in the condition in which you received them.
Unpaid Amounts, Collections & Legal Action
Ownership of rental items. All rental items remain the property of The Tuxedo Club at all times. You are renting, not purchasing, the items, and you hold them as a bailee. Failure to return rental items, or to pay the replacement cost for items you keep, may be treated as unlawful conversion of our property and reported to the appropriate authorities.
If any amount owed under this Agreement (including rental fees, late fees, damage, or replacement/processing costs) is not paid when due, and the payment method on file cannot be successfully charged, your account may be referred to a third-party collection agency and/or pursued through legal action. To the fullest extent permitted by law, you agree to pay all costs of collection, including collection-agency fees, reasonable attorneys' fees, and court costs. You authorize us, and any agency acting on our behalf, to contact you at the phone number(s), email, and mailing address you provided regarding amounts owed.
Chargebacks. You acknowledge that the late fees, damage, and replacement/processing costs described in this Agreement are valid charges that you have authorized in advance. Initiating a chargeback or payment dispute for such legitimately owed amounts is a breach of this Agreement. We reserve the right to contest any such dispute using your order records and this Agreement, and to pursue the amount owed through collections.
Groom Credit Promotion Terms
The Groom Credit promotion is available to qualifying wedding parties with a minimum of five (5) members. To qualify, the groom must create an event, add at least four (4) additional, paying members, and have those members complete their orders before the credit is applied. The Groom Credit amount is based on the rental or purchase amount selected by the majority of the wedding party, up to a maximum credit of up to $200. For example, if the majority of the party spends $200, the groom will receive a $200 credit. If the majority of the party spends $170, the groom will receive a $170 credit.
The credit may be applied toward the groom's rental or purchase order only and cannot exceed the total value of the groom's order. The credit is automatically applied once the qualifying requirements have been met. No promotional code is required. The credit cannot be combined with other promotional offers, discounts, or credits unless otherwise stated. The credit has no cash value, is non-transferable, and may only be used by the member designated as the groom within the event. The Tuxedo Club reserves the right to modify, suspend, or terminate this promotion at any time.
Free Swatches
We provide one (1) free swatch order of up to five (5) swatches per customer, per event, at no charge. Additional swatches beyond that first free order may be purchased upon request, and any additional shipment may be subject to shipping and handling fees.
If we believe the free swatch offer is being abused, we reserve the right to cancel the order at our discretion.
Purchases
Purchase Returns
Purchased items may be returned within 30 days of delivery and before your event date, provided they are unworn, unaltered, and have all original tags attached. Returned items must be in transit back to us within that time.
To begin a return, submit a return request at thetuxedoclub.com/pages/start-a-return. We will email you a prepaid return label within 24 hours. When you submit your request, you may choose:
Exchange credit: the full item value as credit toward a future order. No return shipping cost is deducted.
Refund: a refund to your original payment method for the returned item(s), minus shipping.
Refunds and credits are issued once the returned item is received. If an item arrived damaged or defective, or you received the wrong item, let us know within 48 hours of delivery through the same return form. Custom alterations void the return, and final sale items cannot be returned.
Purchase Delivery/Shipping
Orders over $139 qualify for free standard shipping to ship in approximately 2-5 business days, with the estimated arrival time shown at checkout. Orders under $139 incur a flat shipping rate of $14.95 for standard shipping and ship within 2-5 business days. Optional expedited shipping options are calculated at checkout. If you have a combination of purchase items and rental items on one order, the shipping cost and delivery time will be based on the rental items.
Once the package has been handed over to the shipping carrier, the delivery process is beyond our control, and we cannot be held responsible for any delays caused by the shipping carrier. It is the customer's responsibility to monitor the shipment status with the tracking information provided. We ship only to a valid residence, office, or nationally recognized hotel address within the continental United States. We do not ship to PO Boxes, Hawaii, Puerto Rico or Alaska.
Website Use
Except as expressly provided in these Terms and Conditions of Website Use, neither any part of this website nor any content located herein may be reproduced in any form, copied, republished, posted, publicly displayed, encoded, reproduced, translated, transmitted or distributed in any form to any computer, server, website, or other electronic or other device for purposes of publication or dissemination without written consent executed by The Tuxedo Club. You agree you may not pursue any course of action with the purpose of gaining unauthorized access to the website in any form or by any method whatsoever. You agree not to interfere with the function of the website, or any systems or networks connected to the website. You agree that you will not disguise any communication or access the site using a fictitious identity. You agree that The Tuxedo Club has the right at any time, and without notification, to terminate your access to the website or otherwise interrupt service to the website as necessary or convenient.
Intellectual Property
Copyrights. All materials and content included on this site (including, without limitation, text, graphics, logos, button icons, images, audio clips and software) are the property of The Tuxedo Club, its content suppliers or the parties indicated, and are protected by U.S. and international copyright laws. The collection, arrangement and assembly of all Content on this site is the exclusive property of The Tuxedo Club and protected by U.S. and international copyright laws. All software used on this site is the property of The Tuxedo Club, or its software suppliers, and protected by U.S. and international copyright laws. The Content and software on this site may be used solely as provided in these Terms. Any other use of the Content on this site is strictly prohibited.
Trademarks. The Tuxedo Club, and other The Tuxedo Club graphics, logos and service names are trademarks of The Tuxedo Club. All other marks contained on this site are the sole property of the parties indicated.
Procedure for Making Claims of Copyright Infringement. The Tuxedo Club and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please e-mail or write us with your complaint and include: (1) identification of the copyrighted work claimed to have been infringed; (2) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it; and (3) information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an e-mail address. License & Site Access. The Tuxedo Club owns this site. Within this site and these Terms, when we say "The Tuxedo Club," "we," "us," or "our," we mean The Tuxedo Club. No material from this site may be sold, copied, reproduced, republished, uploaded, displayed, posted, transmitted, distributed, modified, publicly performed, used in any derivative works based thereon or otherwise used for any public or commercial purpose without the prior written consent of The Tuxedo Club or, where applicable, our licensors. The Tuxedo Club grants you a limited license to access and make personal use of this site and not download (other than page caching) or modify it without express written consent of The Tuxedo Club. Changing the Content or using the Content on this site in any other way is a violation of our rights.
Prohibited Conduct. Within this site, you are not allowed to distribute (by whatever means) materials that are libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal, or that we otherwise deem distasteful or objectionable. Except as expressly provided in signed services agreements between you and The Tuxedo Club, you are not allowed to use this site or any of our services in any commercial manner. Any unauthorized commercial solicitation of our customers, clients, partners or guests is prohibited. You are solely responsible for the content of your own messages. We reserve the right to refuse service to you or terminate your account if we, in our sole discretion, believe that your conduct violates these Terms, applicable law, or is harmful to our interests or the interests of our affiliates and partners.
Use of Comments & Submissions. All submissions submitted or offered to The Tuxedo Club on or by this Site (collectively, "Comments") shall be and remain the property of The Tuxedo Club and the sponsors of relevant promotions. Such submissions constitute an assignment to The Tuxedo Club or the sponsors of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. The Tuxedo Club or the Sponsors will own exclusively all such rights and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Neither The Tuxedo Club nor the Sponsors shall be under any obligation to (1) maintain submitted Comments in confidence; (2) pay any compensation for any Comments; or (3) respond to any Comments. You agree and warrant that Comments submitted by you do not violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and do not contain libelous or otherwise unlawful, abusive, obscene or pornographic material. Governing Law & Disputes
Unless otherwise specified, the materials on this site are presented solely for the purposes of marketing The Tuxedo Club and its services. We control and operate this site from our offices in Palmyra, New Jersey, U.S.A. We make no claims that our content is appropriate for use outside of the United States. If you choose to use this site from outside of the United States, you are solely responsible for compliance with your local laws.
Governing law: New Jersey. These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any principles of conflicts of law. Any action at law or in equity arising out of or relating to these Terms, or arising out of this site or your rental, shall be resolved through binding arbitration under the then-current rules of the American Arbitration Association, held in Burlington County, New Jersey, and the resulting decision may be entered in any court with proper jurisdiction. Nothing in this section limits our right to bring an action to recover unpaid amounts, late fees, or the replacement cost of unreturned items in the courts of the State of New Jersey. If any provision of these Terms is unlawful, void, or for any reason unenforceable, that provision shall be deemed severable (or reformed, if necessary) and shall not affect the validity and enforceability of any remaining provisions.
Disclaimers & Limitation of Liability
The Content on our site is provided "AS IS" and without warranties of any kind either expressed or implied. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, The Tuxedo Club DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. To the fullest extent permissible pursuant to applicable law, The Tuxedo Club shall not be liable for any damages of any kind arising from the use of the Content and services offered on this site, including, without limitation, indirect, extraordinary, exemplary, punitive, special, incidental or consequential damages. The Tuxedo Club does not warrant that the functions contained in the Content will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components. We cannot be held responsible for the accuracy, copyright compliance, legality, or decency of material contained in third-party sites, and you hereby irrevocably waive any claim against us with respect to such sites. Product & Service Images and Descriptions. We attempt to be as accurate as possible. However, we do not warrant that product or service images or descriptions or other content displayed on the Site or Service is accurate, complete, reliable, current, or error-free.
Indemnity. You agree to indemnify, defend and hold The Tuxedo Club and its affiliates, and their respective officers, directors, owners, agents, information providers and licensors (collectively, the "The Tuxedo Club Parties") harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys' fees) incurred by any The Tuxedo Club Party in connection with any use or alleged use of the Service under your password by any person, whether or not authorized by you. The Tuxedo Club reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with The Tuxedo Club's defense of such claim.
Limitation of Liability. Under no circumstances, including, but not limited to, negligence, shall The Tuxedo Club be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site, even if The Tuxedo Club or a The Tuxedo Club authorized representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall The Tuxedo Club's total liability to you for all damages, losses and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing this site.
Changes & Acceptance of These Terms
By using this site and areas of other sites maintained by The Tuxedo Club, you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree to these policies, please do not use our site. Your continued use of the site following the posting of changes to these Terms will mean you accept those changes.
